1. General provisions

1.1. “GovTech Lab Lithuania” project (hereinafter – GovTech Lab) as a part of the Innovation Agency Lithuania (hereinafter – Innovation Agency) respects the right to the protection of personal data of all users of the website www.govtechlab.lt (hereinafter referred to as “Website”) and undertakes to ensure it.

1.2. This privacy policy governs the basic principles and procedures for collecting, processing and storing personal data of users of the Website (hereinafter referred to as “Privacy policy”).

1.3. Innovation Agency processes your personal data in accordance with the Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the Regulation), the Law on the Legal Protection of Personal Data of the Republic of Lithuania, the Law on Electronic Communications of the Republic of Lithuania (hereinafter referred to as the “ERRA”) and other directly applicable legal acts regulating the protection of personal data, as well as the instructions of the data protection supervisory authorities (in Lithuania – the State Data Protection Inspectorate).

2. What terms are used?

2.1. Personal data – any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

2.2. Data subject – natural person – a Website user whose personal data is collected by Innovation Agency.

2.3. “Data subject consent” means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;

2.4. Data processing – any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

2.6. Site data processor – Innovation Agency, legal entity code: 125447177, address: J.Balčikonio g. 3, 08247 Vilnius, the data of which is accumulated and stored in the Register of Legal Entities.

2.7. A cookie is a small piece of text information that automatically is created when browsing the Website and is stored on your computer or other device.

2.8. Direct marketing is an activity aimed at offering services to individuals by post, telephone or other direct means and / or inquiring about services.

3. Which personal data we collect?

3.1. Innovation Agencycollects and processes your personal data that you submit yourself by visiting the Website and registering for the GovTech Lab newsletter and for the information about events: e-mail address; and for the registration of events: name, surname, institution or company name, position, e-mail address.

3.2. Innovation Agencycollects and processes your personal data you provide indirectly by visiting the Website and registering for the GovTech Lab newsletter and information about events as well as while registering for events, i.e. IP addresses and time of the login, the user’s browser and its version, device type, usage data, for example, data collected using cookies and similar technologies related to browsing the web etc. is automatically collected from the computers and / or mobile devices you use when you log on to the Website.

3.3. Your personal data indicated in Para 3.1 of the Privacy Policy that you submit when subscribing to news and information about events is stored for 10 (ten) years from the date of their submission, unless you yourself refuse to receive news and information directly through the newsletter. After 10 years you will receive Innovation Agency’s e-mail requesting the continuation of the consent to receive GovTech Lab newsletters and information about events. Your personal data indicated in Para 3.1 of the Privacy Policy that you have submitted during the registration to the events is stored for 2 (two) years. This data may be stored for a longer period only if there are other legal grounds for such a retention period. When you unsubscribe, the data is deleted.

3.4. Your personal data indicated in Para 3.1 of the Privacy Policy is stored for the period of your cooperation with Innovation Agency (during the provision of services) and depending on the type of data can be stored up to 2 (two) years. This data may be stored for a longer period only if there are other legal grounds for such a retention period.

4. For what purposes we process your personal data?

4.1. Innovation Agency processes your personal data as described above for the following purposes:

4.1.1. to identify users of the Website in Innovation Agency administered IS;

4.1.2. to identify and record participants of GovTech Lab events;

4.1.3. with your consent – to send news and information about events to you;

4.1.4. to administer GovTech Lab project;

4.1.5. to execute Innovation Agency’s functions.

5. Who has access to your personal data?

5.1. Innovation Agency employees;

5.2. Innovation Agency employees have access to your personal data subject to the obligation to comply with the requirement of confidentiality and with the necessity to perform their duties as well as to perform the functions of Innovation Agency as a public authority.

6. How we process your personal data?

6.1. Personal data may be processed if:

6.1.1. You provide information about yourself by using the Website (except for data processing that requires the consent of the data subject individually);

6.1.2. you give your consent;

6.1.3. they must to be processed for a legitimate interest pursued by Innovation Agency or a third party to which your personal data is given, provided that your interests and rights are not more relevant;

6.1.4. the processing of the personal data is necessary for the performance of the public interest task or in the exercise of public authority entrusted to Innovation Agency.

7. What rights do you have as the data subject?

7.1. You have all the rights of the data subject specified in the Regulation:

7.1.1. to get information about your personal data processed, i. e. at your request, we will provide you with the processed personal data, along with data processing purposes, data categories, information on recipients of data, etc.;

7.1.2. to object the procession of the personal data if the basis of the processing of personal data, including profiling for direct marketing purposes (e.g. receipt of marketing proposals or participation in surveys) is legitimate interest;

7.1.3. to restrict the processing of personal data in accordance with applicable law, for example, for the period during which Innovation Agency assesses whether you have the right to request that your personal data be erased;

7.1.4. to ask for rectification of the personal data if it is incorrect, incomplete or inaccurate.

7.1.5. to request for the removal of personal data that is processed only with the consent, if you cancel the respective consent. You can also request for the deletion of the data if the processed data is superfluous, data is processed for direct marketing purposes or the data is processed illegally, etc. This right does not apply if the personal data requested to be erased is also processed on another legal basis, such as if the processing is necessary for performance of the contract or enforcement of the obligations under the applicable law (the right to be forgotten). We will remove personal data upon receiving your request by email to info@govtechlab.lt or by mail to GovTech Lab Lithuania (Innovation Agency), J.Balčikonio g. 3, 08247 Vilnius and if you have duly confirmed your identity;

7.1.6. to obtain personal data (relating to you) submitted by you to Innovation Agency and to forward that data to another controller or require Innovation Agency to transfer directly such personal data to another data controller when technically possible (the right to data portability);

7.1.7. to cancel your consent to process your personal data (for example, to revoke consent for direct marketing purposes);

7.1.8. to object the application of a fully automated decision making, including profiling, if such decision making has legal effects or a similar significant effect. This right does not apply if such decision making is indispensable for the purpose of concluding or executing a contract with you, is permitted by applicable law, or you have expressly consented to it.

7.2. If your personal data is erased upon your request, Innovation Agency will only retain copies of the information which is necessary to protect the legitimate interests of third parties, to comply with public authorities’ obligations, to resolve disputes, to recognize interruptions, or to comply with any agreements you have entered with Innovation Agency.

7.3. Please be advised that you if you assume that your rights as data subjects are violated or if you have any questions regarding the processing of personal data, you may submit a request or complaint to Innovation Agency Personal Data Protection Officer by e-mail  duomenu.apsauga@inovacijuagentura.lt. You can also file a complaint with the State Data Protection Inspectorate (www.ada.lt) or you can apply to the court.

8. How we process personal data for direct marketing?

8.1. Only with your prior consent and in accordance with the ERRA, the Law on the Legal Protection of Personal Data of the Republic of Lithuania and the Regulation, we may send you newsletters, email notifications and / or to inquire re the quality of existing services.

8.2. We process your name, surname, and email for direct marketing purposes.

8.3. Your personal data for direct marketing purposes is stored until you have objected to receive direct marketing communications.

9. To whom we transfer your personal data?

9.1. Your data may be provided to third parties only on a legitimate basis, which may include your consent, legal requirement, performance of law enforcement functions, etc. Innovation Agency may transfer your personal data to data processors who provide services to Innovation Agency and process your personal data on behalf of Innovation Agency solely for performing the data processing function necessary to maintain the functionality of the Website. The data processors are not allowed to use your data for other purposes.

11. How to disable and / or uninstall cookies?

11.1. You can control and / or disable cookies yourself. You can disable cookies in two ways:

The steps you need to perform are different depending on the browser you are using, so the specific actions to be performed are specified in the browser description that you are using.

11.1.2. you can set your web browser to block cookies or to receive alerts on the installation of any cookie.

11.2. The browser can be set individually for each device you use.

11.3. Please note that the removal or blocking of the used cookies may affect the functioning of the Website and some of its features, as well as adversely affect your use of the services available on the portal.

12. How do I know about changes of this Privacy Policy?

12.1. As we expand the range of our services, we may need to update this Privacy Policy. Innovation Agency reserves the right to unilaterally modify and (or) supplement this Privacy Policy, so we recommend that you periodically visit Website, where you will always find the latest version.
